The following General Terms and Conditions of Sale govern the offer and sale of products on this web site (https://runescape.backstreetmerch.com/). The products purchased on https://runescape.backstreetmerch.com/ are directly sold by Backstreet International Merchandise Ltd.( t/a BSI Merch)

(hereinafter referred to as "BSI Merch" or "the Vendor" or "We" or "Us").


We may vary these terms and conditions from time to time at our discretion.

 
FORMATION OF CONTRACT 

The goods offered by us may be ordered by you via the internet.
A contract will be formed on acceptance by us of your order.

If you choose to provide us with your email address you will receive communication of the details of your order by email. This confirmation acts only as a verification of order details and does not constitute acceptance of your offer to purchase goods. Acceptance will take place upon receipt of payment.

Your card or Paypal account will be charged as soon as you submit your order. 


BSI Merch will not knowingly allow orders to be shipped or re-shipped via third party forward shipping companies or addresses.BSI Merch does not accept any liability or responsibility for missing or tampered with orders shipped via forwarding addresses and orders placed as such are at customers’ own risk. In the case of recorded music, deliveries to these addresses are excluded from chart reporting. BSI Merch works to identify such behaviour and will reserve the right to cancel your order if we believe an illegitimate forwarding address is being used and reserve any liability for such orders.


We supply all goods at the request of our customers if they are ordered in compliance with these Terms & Conditions.

It is the responsibility of the customer to ensure that all details for their orders are correct at the time of ordering.

Upon placing the order, the customer agrees that the information given on the order is correct. 

BSI Merch will assist where possible if an order does not arrive however if an order is not delivered due to incorrect information supplied by the customer then BSI Merch are not liable and a refund or replacement will not be issued.

 Any changes to information contained on the customer at the time of ordering will be made at the discretion of BSI Merch.

If we experience problems with fulfilling an order we will email the customer with details of the problem and offer an alternative if necessary we may re-process the order to resolve issues that may arise at the point of ordering.


CANCELLATION

You may cancel an order at any time up until 14 (fourteen) days after receipt of the goods. Prior to shipment of the goods, cancellation can be affected by telephoning or emailing Customer Services (customerservices@bsimerch.com). If you cancel the order after the goods have been shipped, the goods must be returned in excellent condition suitable for resale and in the original packaging.

Following notification of cancellation, any sum relating to the canceled order shall be credited to you within 10 working days upon receipt of the goods, provided that the goods are returned by you to us in the condition in which they were delivered.

You will pay for the cost of return and original carriage of the goods unless the goods are faulty or damaged. 

 

NON-RETURNABLE POLICY FOR PERSONALISED ITEMS

Personalised or custom-made items are produced to your specifications and are therefore non-returnable and non-refundable, except in the case of manufacturing defects or if the item does not match the specifications agreed upon at the time of purchase. Please double-check all custom details, including text, colours, and sizing, as they cannot be altered once production has begun.

 

 

FRAUDULENT ORDERS
Attempts to gain goods with false or invalid information will be dealt with as fraud; our system uses some of the best fraud prevention checks provided by our payment provider along with additional algorithms created by our programming team. Orders may be deleted without notification if we believe them to be fraudulent.

If we feel that you are using fraudulent information or credit card data that does not belong to you then we will be forced to pass on any information to the local authorities.
We reserve the right to credit or cancel any order that may appear to be fraudulent or incomplete immediately and without notice to you if:

a. when requested by us to do so, you fail to provide us within a reasonable time with sufficient information to enable us to determine the accuracy and validity of any information supplied by you, or your identity;

b. We suspect you have engaged, or are about to engage, or have in any way been involved, in fraudulent or illegal activity on the website. 





 
PRICE AND PAYMENT 

The price of the goods shall be the price at the date of acceptance by us of your order.
Delivery charges shall be notified to you and shall be added to the price of the goods.
Payment shall be made by you by credit card, debit card or by Paypal.
Delivery shall only be made by us against cleared funds.

Prices are inclusive of VAT at the applicable rate where required i.e. at the standard applicable UK rate within the UK, up to a gross order value of €150 (one hundred and fifty Euros) within EU. Orders over €150 (one hundred and fifty Euros)  and to the ROW will be zero rated in the UK.

Any applicable customs, taxes, or duty charges due on a package must be paid by the person receiving the package. As customs policies and import duties and import tax rules vary widely from country to country, we cannot tell you what these costs would be and therefore suggest you contact your local customs office for details of current charges before ordering. International taxation and duty rules do change from time to time so if you are unsure, please check with your local customs office.


Please note that all orders placed via UK stores are shipped from the UK and on some occasions from Germany due to stock availability. Orders placed via the EU / German stores will be dispatched from Germany and in some cases the UK due to stock availability.


 
LIABILITY 

Our liability to you for the goods shall be limited to the purchase price of the goods.
We shall not be liable for any loss of use, loss of revenue or loss of profit by you. 


 

FORWARDING ADDRESSES

BSI Merch reserves the right to cancel any order suspected of being placed using a secondary or forwarding address. If a forwarding address is used then BSI Merch will not be liable for any lost , damaged , missing or undelivered orders. Customers are strongly advised to not use forwarding addresses and doing so is at their own risk.

 
EVENTS BEYOND THE CONTROL OF BSI MERCH

We shall have no liability to you for any failure to deliver or for any delay in doing so for any damage or defect to the goods which is caused by any act or circumstance beyond our reasonable control including, without limitation, strikes and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident. 

OUT OF STOCK

From time to time there may be a very high volume of customers ordering the same popular item, which can lead to stock fluctuations resulting in an oversell of a product. In this instance, it means that we unfortunately can't fulfill all the orders where product stock levels are limited.

If you receive an email letting you know that your order was canceled, this means that we were unable to fulfill your entire order or part of your order.

When this happens, please be assured that your money has been refunded to your original payment method and can take anywhere from 3 - 5 business days to show back in your account.



SAFE WORKPLACE POLICY
BSI Merch operates a strict zero-tolerance policy towards work-related violence and aggression, including abusive and threatening communications or behaviour. As an organisation we want to eradicate, and will not tolerate, work-related violence and aggression towards our staff. We believe that it is neither inevitable nor acceptable that anyone should face violence and aggression at work, either in person, on the phone or via digital communications .

 

Abusive behaviour - Abusive behaviour can happen in person, online or in writing. 

 

We consider abusive behaviour to be the use of inappropriate words, behaviour or actions that cause distress to a BSI Merch employee some examples are given below:

  • Offensive or abusive language, verbal abuse and swearing
  • Unwanted or abusive remarks 
  • Negative, malicious, or stereotypical comments 
  • Persistent or unrealistic demands that cause stress to staff. 

 

Threatening behaviour - Threatening behaviour can happen in person, online or in writing. 

 

We consider threatening behaviour to be the use of inappropriate words, behaviour or actions with the intent to cause mental or physical harm to a BSI Merch employee some examples are given below: 

  • Written, recorded or in person threats to a member of staff 
  • Acts of bullying, victimization, or intimidation
  • Racial abuse and sexual harassment 
  • Invasion of personal space 
  • Any physical violence towards a BSI Merch employee, such as hitting, grabbing, pushing or shoving 
  • Brandishing of objects or weapons at a BSI Merch event 
  • Near misses i.e. Unsuccessful physical assaults 
  • Stalking 
  • Spitting

 

Any breach of this policy will immediately result in any communication being terminated and can result in orders being canceled and where necessary information being passed to the relevant authorities.



DATA PROTECTION

By agreeing to these terms and conditions, and unless otherwise notified by you, you agree that BSI Merch from time to time might send promotional mail to you. These promotional mailing will stop if requested by you.

No customer information, including email addresses shall be given or sold to any third parties in accordance with our privacy policy.

 


ASSIGNMENT

Our rights and obligations and yours shall not be assigned without our prior consent in writing.

 
THIRD PARTY RIGHTS

A person who is not a party to the contract between ourselves and you shall have no right under the Digital Services Act (DSA) and the Digital Markets Act (DMA) to enforce any term of the contract. 



PARTIAL INVALIDITY 

If any of these terms and conditions or any part thereof are unenforceable, the enforceability of all other terms and conditions shall not be affected. 



WAIVER

No failure by us to exercise any right or remedy under these terms and conditions shall operate as a waiver of that right or remedy and no waiver by us of any breach of these terms and conditions shall operate as a waiver of any subsequent breach.

From time to time BSI Merch will offer ‘no purchase necessary’ promotions.

A purchase will not increase your chance of winning.

Entry is open to all customers worldwide except for employees (and their families) of BSI Merch Ltd /BSI Merch GmbH, their clients, the suppliers of the prizes and any other companies associated with the competitions.


The entrant(s) and participant(s) must be aged 16 or over, unless otherwise stated. 

 

Proof of identity and age may be required.


Use of a false name or address will result in disqualification.  


All entries must be made directly by the person entering the competition. 

 

Entries made online using methods generated by a script, macro or the use of automated devices will be void.  


No responsibility can be accepted for entries lost, delayed, or corrupted, or due to computer error in transit.

Confirmation of the prize will also be made via email to the winner(s).
